These Terms and Conditions (Terms) apply to the Blue Mountains Jiu Jitsu Academy Pty Ltd (BMJJA) promotion offering 30 % off your first six months of membership, a free uniform and a 30‑day money‑back guarantee(Offer). By applying for or redeeming this Offer, you agree to be bound by these Terms and by BMJJA’s standard membership agreement (together, the Agreement). Where there is any inconsistency between these Offer Terms and the standard membership agreement, these Terms prevail for this Offer only.
1. About the Offer

Promotion overview: BMJJA is reopening on 2 February 2026, and this Offer is available only to new members who sign up on or before that date. You receive a 30 % discount on BMJJA membership fees for the first six months and one free uniform (gi). The Offer is subject to available uniform stock and may be withdrawn at any time before 2 February 2026.

Eligible memberships: The Offer is available to new Kids or Adults members who have not held a BMJJA membership in the preceding 12 months. The membership provides unlimited training (full‑time class access). BMJJA reserves the right to decline enrolment based on age, capacity, or other factors consistent with its programs.

Discount period: When you sign up for an eligible membership before 2 February 2026, your membership fees are discounted by 30 % for the first six months (Discount Period). After the Discount Period, your membership continues at BMJJA’s standard rate unless you cancel in accordance with clause 5 below.

Uniform supply: Under this Offer, BMJJA supplies one official BMJJA gi at no cost when your membership commences or within a reasonable time after. The gi’s retail value is A$179 for adults or A$159 for kids. If you cancel your membership under the 30‑day money‑back guarantee (see clause 5), you must return the gi in reasonable condition or pay a replacement fee equal to its retail value; otherwise the gi becomes your property at no charge after the 30‑day period.
2. Ongoing Membership and Membership Fees

Subscription‑based membership: By accepting the Offer, you enter into a subscription‑based membership that continues until cancelled. Membership fees are A$48 per week (standard rate) and are debited weekly or fortnightly from your nominated account via direct debit. During the Discount Period, the fees are reduced by 30 % (i.e., A$33.60 per week). Membership fees will begin on or after the reopening date and continue until you cancel.

Direct debit authority: You authorize BMJJA to debit your nominated payment method while you are subscribed. You must keep sufficient funds available for each payment and not cancel your direct debit authority without first making alternative arrangements. If a payment is dishonoured, BMJJA may charge a reasonable fee, and you remain liable for the unpaid amount.

Membership freeze: You may freeze your membership by giving at least 15 days’ notice and submitting a freeze request form specifying a return date; the maximum freeze period is 60 days. Freeze and cancellation are separate processes: to cancel during a freeze, the membership must be reactivated, payments brought up to date and remain active for the remainder of the notice period.

Notice requirements: Notice to freeze or cancel must be given in person at the gym using the appropriate form or, if that is not possible, by requesting the form via email. Notices cannot be provided via SMS, phone or social media.

Class attendance: Your class attendance is independent of your payment obligations. BMJJA will provide classes and instruction, but it is your responsibility to notify BMJJA of any freeze or cancellation request.
3. Payment & Direct Debit Authority

You agree to complete and sign BMJJA’s direct debit request form and to ensure sufficient funds are available on each payment date. Cancelling your direct debit authority does not cancel your membership or remove your obligation to pay any amounts validly due under the Agreement.

If a payment is dishonoured or rejected, BMJJA may charge a reasonable dishonour fee. You agree not to close your bank account or cancel your credit card without first arranging for cancellation of your membership subscription.
4. Uniform – Supply, Ownership & Return

One (1) BMJJA gi (jacket, pants, belt and rashguard) is supplied at no cost when your membership commences or within a reasonable time after. The gi is for the exclusive use of the enrolled student.

If you cancel your membership during the 30‑day money‑back guarantee (clause 5) and wish to obtain a full refund, you must return the gi in reasonable condition. If the gi is not returned or is returned in a condition beyond normal wear and tear, BMJJA may deduct a replacement fee equal to the retail price (A$179 for adults or A$159 for kids) from any refund or invoice you separately for that amount.

If you cancel your membership after the 30‑day money‑back guarantee period, the gi becomes your property at no additional cost.

You agree to wear the official BMJJA uniform to class and to sign in for each class and update your membership program upon achieving higher grading.
5. 30‑Day Money‑Back Guarantee & Cancellation
5.1 30‑Day Money‑Back Guarantee

Eligibility: You are entitled to a 30‑day money‑back guarantee if you sign up under this Offer on or before 2 February 2026. The guarantee period commences on the reopening date.

Cancellation during guarantee: During the guarantee period, you may cancel your membership for any reason by providing written notice to BMJJA (email is sufficient). If you cancel and return the gi as required, BMJJA will refund 100 % of membership fees and any enrolment fees paid up to the effective date of cancellation.

Effect of cancellation: If you exercise the 30‑day guarantee and comply with the gi return requirements, your membership ends immediately, and no additional amounts are payable. If you do not return the gi or it is returned in poor condition, BMJJA may deduct a replacement fee from the refund.
5.2 Standard Cancellation after the Guarantee Period

Notice requirement: After the 30‑day guarantee period, you may cancel your membership for any reason by giving 30 days’ written notice (standard cancellation notice). Membership fees remain payable during the notice period.

Discount during notice: If you give notice during the Discount Period, the 30 % discount will continue for any part of the 30‑day notice period that falls within the Discount Period. Any portion of the notice period after the Discount Period will be charged at the standard membership rate.

No clawback: Other than paying membership fees properly due up to the effective date of cancellation, there is no repayment or clawback of promotional benefits once the guarantee period has ended.

Effectiveness of cancellation: Cancellation is effective when your written notice has been received and all outstanding membership fees and charges have been paid in full.
5.3 Cancellation in Special Circumstances
You may cancel your membership without the standard 30‑day notice if any of the following occur after joining:

Medical condition: You (or the enrolled student) develop a medical condition that prevents participation in Brazilian Jiu‑Jitsu for at least 90 consecutive days.

Deployment: You (or the enrolling parent/guardian) are deployed for military service such that attending classes is not reasonably practicable.

Unexpected unemployment: You (or the enrolling parent/guardian) are unexpectedly made unemployed.
To cancel under this clause, you must provide BMJJA with reasonable documentation (e.g., a medical certificate, deployment orders or a termination letter). BMJJA may request further information but will not unreasonably refuse a valid special‑circumstances cancellation. If cancellation occurs during the 30‑day guarantee, the gi must be returned to receive a full refund; otherwise, you may keep the gi with no additional payment required.
6. Membership Freezes and Cancellation While on Freeze

Freeze request: You may request to freeze your membership in accordance with BMJJA’s standard membership terms. Freeze requests require 15 days’ notice, and the freeze period may not exceed 60 days.

Fees during freeze: Membership fees may be reduced or suspended during the freeze period in accordance with BMJJA’s standard terms. Details of any freeze fees or reduced fees will be provided at the time of your request.

Cancellation while frozen: To cancel a membership while it is on freeze, the membership must first be reactivated, all payments must be up to date and active for the remainder of the 30‑day cancellation notice periodbmjja.com.au. Fees during this notice period are charged at the applicable rate (discounted or standard).
7. Our Rights to Cancel or Suspend
BMJJA may suspend or cancel your membership in accordance with its standard membership terms (for example, for non‑payment of fees, serious breach of club rules or unsafe conduct), subject always to the Australian Consumer Law.
If BMJJA cancels your membership without fault on your part, it will refund any prepaid membership fees on a pro‑rata basis, except to the extent permitted by law or where you have already received the full benefit of the relevant fees.
8. Assumption of Risk & Limitation of Liability

Assumption of risk: Martial arts training involves inherent risks, including potential serious injury, disability or death. By accepting this Offer and participating in BMJJA classes, you acknowledge these risks and agree to assume full responsibility for your participation and any resulting harm.

Physical fitness: You certify that you are physically fit and free from any condition that could impair your performance or well‑being during training and agree to inspect the facilities and equipment before participating. You consent to receive medical treatment in the event of injury.

Release of liability: You release BMJJA, its officers, employees, instructors and related parties from liability for any injury, death or property damage you may experience during participation, whether caused by negligence or otherwise. This release is subject to statutory rights under the Australian Consumer Law, which cannot be excluded.

Australian Consumer Law: Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot be excluded. Where services are not of a kind ordinarily acquired for personal, domestic or household use, BMJJA’s liability is limited, to the maximum extent permitted by law, to resupply of the services or payment of the cost of having the services supplied again.
9. General

Amendments: BMJJA may amend or withdraw this Offer at any time before 2 February 2026. Any changes will not affect members who have already entered into the Offer on these Terms, except where required by law.

Notices: Any notice you give under these Terms must be in writing and sent to BMJJA via email or another method specified by BMJJA. Notices are taken to be received when BMJJA confirms receipt or, for email, when the email is successfully sent without bounce‑back and BMJJA processes it within the stated response time.

Severability: If any part of these Terms is found to be invalid or unenforceable, that part will be read down or severed to the extent necessary, and the remainder will continue in full force and effect.

Governing law: These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the non‑exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
